Terms & Conditions for Consultations and Custom Art Commissions 

1. Purpose of Consultation

Consultations are planning sessions only. They are intended to discuss ideas, styles, sizes, timelines, and artistic direction. A consultation does not include any sketches, drafts, digital designs, prints, or canvas products.

2. Estimates and Project Details

After the consultation, you will receive a written estimate outlining:

  • Project terms and conditions

  • Selected size and medium (original oil pastel canvas, digital artwork, or print canvas)

  • Proposed timeline

  • Pricing structure and any additional costs This estimate is not a contract until formally approved and signed.

3. Concept Design & Review 

You will receive a password‑protected link to view your concept design. All concept images will include a visible watermark to protect the artist’s intellectual property. Concept designs are for review purposes only and may not be downloaded, copied, or shared without written permission.

4. Approval, Contract & Deposit 

Work on the final art piece will begin only after:

  • Approval of the concept design

  • Signature of the commission contract

  • Payment of a non‑refundable deposit covering material costs This deposit will be credited toward the final invoice when the completed piece is shipped or delivered.

5. Pricing & Materials 

Prices listed in consultations or on the website do not include:

  • Prints

  • Canvas products

  • Digital design files

  • Shipping or packaging These will be itemized separately in the final estimate.

6. Intellectual Property & Usage Rights

The artist retains all copyright and reproduction rights to concept designs and final artworks unless otherwise agreed in writing. Clients may not reproduce, sell, or alter the artwork without explicit permission. Personal display rights (in home or private space) are granted upon full payment.

7. Revisions

One round of minor revisions to the concept design is included unless otherwise stated. Additional revisions may incur extra fees, which will be communicated before any changes are made.

8. Timelines & Delays

Estimated timelines are provided in good faith. Delays may occur due to material availability, artistic process, or unforeseen circumstances. Clients will be notified promptly of any changes.

9. Payments & Final Delivery

The remaining balance is due before shipping or digital delivery of the final piece. Shipping costs, insurance, and packaging fees will be included in the final invoice. All sales of custom artwork are final, in accordance with Canadian custom‑goods standards.

10. Cancellation Policy

If the client chooses to cancel after the contract is signed, the non‑refundable deposit will not be returned. Any additional work completed at the time of cancellation may be billed at the artist’s discretion.

11. Compliance with Canadian Regulation

These terms follow standard Canadian business practices for custom goods, including:

  • Transparency in pricing

  • Clear disclosure of non‑refundable deposits

  • Protection of intellectual property

  • Fair communication regarding timelines and revisions Clients are encouraged to ask questions at any time to ensure clarity and mutual understanding.
